Discipline and Complaints

Basketball New Brunswick is committed to providing a safe, respectful, and fair sport environment for all participants. Concerns related to conduct, behaviour, or safety are taken seriously and addressed in accordance with applicable policies and procedures.

Basketball New Brunswick uses a tiered approach to complaint handling, consistent with the Safe Sport framework established by Sport New Brunswick and the Government of New Brunswick.

You do not need to determine which policy or process applies before raising a concern. Basketball New Brunswick will review the information received and determine the appropriate next steps.

How concerns are handled

Concerns are generally addressed in one of the following ways:

Safe Sport / Maltreatment (UCCMS)

Concerns involving alleged maltreatment, including abuse, harassment, discrimination, or other conduct covered by the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (UCCMS), are referred to the NB Safe Sport Complaint Mechanism and/or the Office of the Sport Integrity Commissioner, as required.

Code of Conduct and Ethics

Concerns involving behaviour, professionalism, or compliance with Basketball New Brunswick policies that do not involve maltreatment are addressed internally under Basketball New Brunswick’s Discipline and Complaints Policy.

Fair Play and Competition Matters

Concerns related to game or training conduct, competition integrity, or Fair Play are addressed under Basketball New Brunswick’s Fair Play Policy and applicable competition rules.


 

What to expect after raising a concern

Depending on the nature of the concern, Basketball New Brunswick may:

  • request additional or clarifying information,

  • address the matter internally under applicable policies,

  • refer the matter to an external Safe Sport mechanism, or

  • apply disciplinary measures in accordance with policy.

Not all concerns follow the same process, and not all matters are referred externally.


Important note

Concerns involving alleged maltreatment are not handled through internal disciplinary processes and are directed to the appropriate Safe Sport mechanism in accordance with provincial and national requirements.


 

NB Safe Sport Mechanism 

The NB Safe Sport Complaint Mechanism (NBSSCM) strives to provide support to complainants within the New Brunswick amateur sport system for certain disputes by accessing an independent and unbiased Case Manager mechanism. The NBSSCM is designed to respond to the needs of the PSO/MSO members of Sport NB when navigating the complaints management process.

The following may be eligible to enter the program:

  • Complaints of Maltreatment as defined in the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (UCCMS)
  • Two types of appeals (subject to grounds for appeal):
    1. Final decisions of a PSO/MSO alleging that it failed to follow their constitution/by-laws or policies
    2. Final arbitral decisions made by a Mediator/Arbitrator appointed under the NBSSCM

Sport NB has proudly partnered with ITP sport for the administration of the NBSSCM.  All complaints will now be received through IntegrityCounts, a secure and independent reporting intake and case management system.  This secure online platform is available to members 24/7/365, and ensures that all complaints are managed through independent expert consultation services.

For individuals who would like to report a complaint via phone, please email nlaird@itpsport.ca with the subject heading: Sport NB - Complaint Phone Submission. In your email, please indicate preferred days, times and language for a case manager to do a phone intake.
